2. Scope of Application

These Terms and Conditions apply to all purchases made through this website.

By placing an order, you agree to these Terms and Conditions.

Nothing in these Terms limits any mandatory consumer rights granted under applicable law.

3. Products

We sell high-quality art prints based on original handmade gouache artworks created by Bruno Griguoli.

Unless explicitly stated otherwise:

  • Products are sold as prints only.
  • Original artworks are not included.
  • Frames and decorative items shown in photographs are not included.
  • Product images are for illustrative purposes.

4. Print Specifications

All prints are supplied in:

A3 size
29.7 × 42 cm (11.7 × 16.5 inches)

Additional specifications may be listed on individual product pages.

5. Colors and Product Representation

We make every reasonable effort to display colors and details accurately.

However, slight differences may occur due to:

  • screen settings and calibration;
  • device display variations;
  • printing processes;
  • paper characteristics;
  • lighting conditions.

Such variations do not constitute a defect.

6. Intellectual Property Rights

All artwork, designs, images, illustrations, text, logos, and content displayed on this website remain the exclusive intellectual property of Bruno Griguoli unless otherwise stated.

The purchase of a print does not transfer:

  • copyright;
  • reproduction rights;
  • distribution rights;
  • commercial use rights;
  • licensing rights.

You may not reproduce, scan, copy, distribute, modify, sell, or commercially exploit any artwork without prior written permission.

7. Prices

All prices are displayed in Euros (€).

Prices include VAT where applicable under Dutch law.

Shipping charges are shown separately during checkout or in the shipping information section.

We reserve the right to change prices at any time. Price changes do not affect orders already accepted.

8. Orders and Contract Formation

Placing an order through the website constitutes an offer to purchase.

After an order is submitted:

  1. We will send payment instructions by email.
  2. Payment must be received before shipment.
  3. A binding sales agreement is formed only after payment has been received and the order has been accepted.

We reserve the right to refuse or cancel orders in cases including:

  • suspected fraud;
  • technical errors;
  • pricing mistakes;
  • product unavailability.

If an order is cancelled after payment has been made, any payment received will be refunded.

9. Payment

Payment details will be provided by email after an order is placed.

Orders will be packed and shipped only after full payment has been received.

If payment is not received within 7 calendar days of our payment instructions being sent, we reserve the right to cancel the order and make the product available for sale again.

10. Shipping

Delivery Area

We currently ship within the Netherlands only.

Packaging

Prints are shipped flat in a rigid ColomPac A3 cardboard envelope or equivalent protective packaging.

Tracking

Orders are shipped with tracking.

Tracking details will be provided by email once the shipment has been dispatched.

Delivery Times

Delivery times are estimates only and are not guaranteed.

Delays caused by postal services, holidays, weather conditions, or circumstances beyond our control may occur.

11. Risk and Delivery

Risk of loss or damage passes to the customer when the goods are delivered to the delivery address provided.

This provision applies only to the extent permitted by applicable consumer protection laws.

12. Right of Withdrawal (EU Consumers)

If you are a consumer residing within the European Union, you have the legal right to withdraw from your purchase within 14 days after receiving the goods without giving any reason.

To exercise this right, you must notify us by email before the withdrawal period expires.

You must return the goods within 14 days after informing us of your decision to withdraw.

13. Returns

To qualify for a return:

  • the print must be unused;
  • the print must not be damaged;
  • the print should be returned in its original packaging where reasonably possible;
  • proof of purchase may be required.

Customers are responsible for return shipping costs unless:

  • the product was damaged upon arrival; or
  • an incorrect item was supplied.

14. Refunds

After receiving and inspecting the returned item, we will process any applicable refund.

Refunds will be issued within 14 days after receiving the returned goods or receiving proof of return shipment, whichever occurs first.

Refunds will be made using the original payment method whenever possible.

Shipping costs may be refunded where required by applicable consumer law.

15. Damaged or Incorrect Items

If your order arrives damaged or if you receive the wrong item, please contact us as soon as possible.

To help us resolve the issue, please provide:

  • your order number;
  • clear photographs of the item;
  • photographs of the packaging.

Depending on the circumstances, we may offer:

  • a replacement;
  • a refund; or
  • another appropriate solution.

Nothing in this section limits your statutory consumer rights.

16. Limitation of Liability

To the maximum extent permitted by law:

  • our liability is limited to the purchase price of the affected product;
  • we are not liable for indirect, incidental, consequential, or special damages.

Nothing in these Terms excludes liability where exclusion is prohibited by law, including liability for fraud, intentional misconduct, or mandatory consumer protections.

17. Force Majeure

We are not responsible for delays or failures resulting from events beyond our reasonable control, including but not limited to:

  • natural disasters;
  • severe weather;
  • strikes;
  • transport disruptions;
  • internet outages;
  • governmental measures;
  • supply chain interruptions;
  • pandemics.

Where such circumstances occur, we will make reasonable efforts to fulfil our obligations as soon as possible.

18. Fraud Prevention

We reserve the right to refuse, suspend, or cancel orders where fraudulent activity, abuse, or unauthorized payment activity is suspected.

Where necessary, we may take appropriate legal action to recover losses.

19. Complaints

If you have a complaint, please contact us using the contact details provided above.

We will make reasonable efforts to respond and resolve complaints promptly.

20. Governing Law

These Terms and Conditions are governed by the laws of the Netherlands.

If you are a consumer residing in another country, you continue to benefit from any mandatory consumer protections granted by the laws of your country of residence.

We may update these Terms and Conditions from time to time.

The version published on the website at the time of purchase will apply to your order.
